Purpose

This Appeals Policy aims to create a fair and open process for people or organizations to challenge NLSA grading decisions. This policy describes how to file an appeal, what qualifications are required, and how the appeals process works.

Scope

All parties seeking to challenge a NLSA judgment must follow the guidelines in this policy. Among the many topics that may be the subject of appeals are disciplinary actions, eligibility determinations, test results, and access to programs or services, among others.

Eligibility for Appeal

The appellant must fulfill the following requirements in order to be qualified for an appeal:

a. The decision being appealed must be within the scope of matters outlined in the Scope.
b. The appellant must have a direct and substantial interest in the decision being appealed.
c. The appeal must be submitted within the specified timeframe, as outlined in the Appeals Process.

Appeals Process

The following steps outline the appeals process:

Step 1: Submission of Appeal

    1. The appellant must submit a written appeal to NLSA within 30 calendar days from the date of the decision being appealed.
    2. The appeal must include the following information:

– Name and contact information of the appellant.
– Detailed description of the decision being appealed.
– Grounds for the appeal, including any supporting documents or evidence.

Step 2: Appeal Review

    1. Upon receipt of the appeal, NLSA will promptly acknowledge the receipt and assign a designated individual to review the appeal.
    2. The designated individual will conduct an impartial and thorough review of the appeal, taking into consideration all relevant information and supporting documentation provided.

Step 3: Appeals Decision

    1. Following the review, NLSA will provide a written decision on the appeal to the appellant within 30 calendar days from the date of receipt of the appeal.
    2. Any additional actions or remedies, if any, will be included in the decision on the appeal, together with a clear explanation of the decision’s reasoning.

Confidentiality and Privacy

All information provided during the appeals process will be handled legally and in complete confidence in compliance with all applicable privacy laws and regulations.

 

Finality of Decisions

The outcome of any appeals shall be final and binding, subject to any laws or regulations that may be in force at the time.

 

Amendments to the Appeals Policy

This Appeals Policy is subject to change at any time, at NLSA’s discretion. Any modifications will be disclosed to the appellant in a new policy document.

 

Policy Review and Compliance

This policy will be reviewed regularly to ensure its continued relevance and compliance with data protection laws and regulations.
