Introduction

The NLSA’s policies and processes for preventing, identifying, and dealing with cases of malpractice within the organisation are outlined in the Malpractice Policy. This policy seeks to uphold honesty, integrity and ethical practices in all activities and operations with the highest levels of responsibility and professionalism.

 

Scope

This policy applies to all employees, contractors, instructors, partners, and stakeholders of NLSA. It encompasses all activities, programs, assessments, certifications, and other processes conducted by NLSA.

 

Definition of Malpractice

Malpractice refers to any intentional or negligent act that undermines the integrity, fairness, or validity of NLSA’s activities or violates ethical standards. It includes but is not limited to:

    • Cheating, plagiarism, or unauthorised collaboration during assessments or examinations.
    • Misrepresentation or falsification of credentials, qualifications, or documentation.
    • Unauthorized access, alteration, or disclosure of confidential information or data.
    • Violation of copyright, intellectual property rights, or proprietary information.
    • Any other conduct that compromises the reputation, credibility, or ethical standards of the organisation.

Prevention Measures

NLSA will implement the following measures to prevent malpractice:

    • Clearly communicate and educate employees, learners, instructors, and stakeholders about the expectations, policies, and consequences related to malpractice.
    • Establish secure systems and protocols for the management, storage, and protection of confidential data and intellectual property.
    • Develop and administer fair assessment and examination procedures that minimize opportunities for malpractice.

Reporting and Investigation

Anyone who becomes aware of or suspects malpractice should report the incident promptly to the NLSA Director. The Director will conduct thorough and impartial investigations, respecting the principles of natural justice, confidentiality, and due process.

 

Disciplinary Actions and Remedies

If malpractice is substantiated following an investigation, NLSA will take appropriate disciplinary actions and remedies, which may include but are not limited to:

    • Academic penalties, such as nullifying assessment results or revoking certifications.
    • Termination of employment or contracts.
    • Legal actions, if necessary, to protect NLSA interests.
    • Implementation of corrective measures to prevent future instances of malpractice.

 

Training and Awareness

NLSA will provide training and awareness programs to employees, instructors, and stakeholders to promote a culture of integrity, ethics, and responsible conduct. These programs will educate individuals about malpractice risks, prevention measures, and the importance of upholding the organization’s standards.

Policy Review

This Malpractice Policy will be periodically reviewed and updated as necessary to align with changing circumstances, legal requirements, and best practices. NLSA will communicate any revisions or updates to relevant stakeholders to ensure continued compliance and understanding.
